Abstract
Political, economic, and social changes in Slovenia triggered changes in the way work is being organised in organisations. Relationships between employees and employers are based on the contractual basis. This changes the main characteristics of relationships within organisations. One of the key changes is the change in authority and the status of people who are in charge of other people. Various categories of managers, all belonging to the so-called management, comprises of people for which our legislation uses different legal terms. Regulation controlling the role of management in private sector and regulation controlling the role of management in public sector came into existence at different times. Both have substantially changed in a rather short period of time in which the new constitutional and legal order was put into force in Slovenia. As a consequence, by-laws are not harmonised, the situation is unclear and full of legal lacuna. Legislation in this area and the authority of management have not been entirely regulated, thus the field should be thoroughly analysed in order to find areas that should be improved. In addition to this, the proposed project will also deal with the most efficient ways of regulating the status of managers with contracts. Employing managers on the basis of labour law does not sufice, as we should also try to deal with the possibility of their employment from the point of view of civil law and, last but not least, from the point of view of company law. An important aspect of our analysis will be the analysis of the esprit de corps, the way trade unions are organised and managerial activities, negotiations on working terms and standards in labour legislation and statutory standards for exercising their rights.
