Abstract
The unexpected widespread success of the Internet, coupled with the ever growing computer literacy, has witnessed the emergence of the so-called "cyber society", which is, on the one hand, much more sophisticated and developed than any of its "real" counterparts, pluralism, tolerance, free movement and freedom of speech being not only its values but a fact. On the other hand, this society is, like the "real" ones, faced with a variety of social problems and, specifically, crime. Cyber crime, however, has a special characteristic; apart from the "old" (already known) crimes that are merely carried out in the specific (computer-related) way, there are others (internet-related) crimes like illegal access, data or system interference etc. that are specifically new. It is this latter category of crimes we propose to study at this point. The study will involve a varity of issues of theoretical as well as of practical nature and will give special emphasis on the present situation and trends in Slovenia.
The research will encompass three aspects:
(a) the legal aspect shall, among the overview of relevant domestic, foreign and international literature, analyse the appopriateness/efficiency of solving the subject-matter with the criminal law, which leads up to several other questions regarding the measurement of the appropriateness/efficiency, the role of the victim etc;
(b) the criminological aspect will involve a sociological analysis of certain typical cyber-crimes and inspect the very legitimacy of the repressive state interventions into the, so far still more or less autonomous and private, sphere of the individual within the liberal society; and finally
(c) the computer-scientific aspect shall offer a more detailed explanation of the way in which certain cyber crimes are carried out and locate the possible technical crime-prevention solutions.
