Within the project "Reform of noncontentious civil procedures" an international scientific conference "Non-Contentious Procedures in Property and housing matters" led by prof. Dr. Vesna Rijavec was organised. Lecturers were discussing topical issues of noncontentious procedures, which are foreseen for regulation of relations in the filed of preoperty and housing law. These are procedures, starting with proposal, which is particularly topical issue, the extent to whichnoncontentious civil procedure rules differ from the rules of civil procedure. An important part of the project represent contributions with comparative view in the field of German, Austrian, Serbian and Bosnia and Herzegovina law dealing with the fundamental principles and position of the parties and the court in these proceedings. Within the conference the research group published a thematic issue of journal Lexnomica, no. 2/2010 and the contributions are available on http://www.lexonomica.com/journal/index.php/volume-ii-letnik-ii/lexonomica-02-2010.

COBISS.SI-ID: 4203051This publication is with introductionary explanations result of the participation of the project leader in working groups for preparation of viewpoints or proposals for a legislative amendments of Enforcement and Securing of Civil Claims Act. Her work represents contribution to funcioning of the economy, although the execution of proposed legislative reform project unfortunately, due to legislative haste, was not taken into consideration in the same way as was conceived by working group led by prof. Rijavec. Prof. Rijavec has lectured on several seminars on this subject (November 17, 2010, Nebra, September 8, 2010GV Press, June 22, 2011GV Publisher), in which she gave the answers that parties need when they whish to enforce the changes in practice.

COBISS.SI-ID: 4146731Research group also examined the expert evidence in civil procedure with special emphasis on frequently asked questions in practice, namely: prerequisites and criteria for the choice of expert, extent of discovery principle and preclusions according to missed evidence proposals or missed evidence payment,the extent of expert's authority and duties and the replacement of expert or nomination of more experts successively or simultaneously, the content of expert evidence. The expert hired by parties is not an expert in the court procedure but can be heard as an expert witness. It is stressed that the judge is the only one in charge to evaluate the taken evidence for thejudicial decision and the expert is only assisting him/her with his/her expertise. The problem of costs are also taken into consideration.
