Povzetek
The advocacies and researches of students and academics on the application of the EU law at the courts in Slovenia (more particularly in Maribor) is a triangle project involving students, professors, i.e. tutors and judges. Project is based on win-win situation. The basic idea of the project is the following: an opportunity is given to the students to be involved in the adjudication process at the courts regarding the EU law. They are visiting courts, where they receive the court file, not yet adjudicated. The file is studied at the court under supervision of the judges. Students shall than study the legal issues of the case and are asked to prepare the opinion, which shall answer whether (how) the EU law applies to the case, or not. Arguments (in both cases) are crucial. Opinions shall also include jurisprudence of the EU Court, comparative practice, theoretical approaches, etc. During the process of drafting the opinions, tutors, i.e. professors, are deeply involved. They prepare reviews of the opinion and offering consultations to students for each individual opinion. Reviews shall give guidance, rather than answers, helping students to prepare useful opinions with a research and advocacy for the case in question. This theoretical-pragmatic approach with the closer cooperation of the Administrative, Regular and Labour Courts in Maribor (already agreed) is a new challenge in EU law studies which brings closer students, professors (tutors) and courts and whereby students actively participate in the decision-making process (amicus curiae). This way and by consultation given by the tutors, they obtain also legal skills necessary for independently solving cases with the EU law involvement. Even more, the project is win-win situation. All stakeholders win: students with new knowledge on EU law and legal skills, courts and judges by obtaining the useful opinion, and professors being aware of the actual cases at the courts and combining theory with the practice.
