Abstract
The object of this research shall be the assessment of incompatibilities between Serbian business law and business law of the European Union. Considering that business law is a very broad discipline, the assessment of incompatibilities shall not be conducted from an abstract point of view. Rather, a separate assessment shall be made for each particular branch of business law. The main areas of research shall be: Company Law, Law of Financial Markets (Securities Law), Competition Law, International Commercial Law, Banking Law, Insurance Law, Tax Law, Insolvency Law and Intellectual Property Law. For each of these branches, the researchers shall select focal problematic points, analyze them from the perspective of Serbian law and compare them with the legislative solutions adopted in the European Union. The outcome of the first stage of the research should be the conclusions on the level of harmonization of Serbian law with the rules of the EU. The second stage of the research shall be dedicated to providing explanations for different legislative solutions adopted in the European Union, where necessary. The idea is to reach understanding of the purpose and the underlying economic and legal logic of the European legislative solutions which are not yet implemented in Serbia. At the last stage, this project shall propose adequate changes of the Serbian business legislation which will eventually lead to harmonization of Serbian law with EU law.
