Abstract
Proposed research project “Legal aspects and information technology support in the process of democratization of governance of public and private legal entities and industrial relations” consists of three main research topics: 1. Democratization of governance of public and private legal persons. 2. Social dialogue, employee participation and human rights protection as essential element of democratization of modern societies 3. Information technology in the process of democratization of governance and industrial relations. Proposed Research project will be performed through interdisciplinary research work experts in law, economics and information technology. The main goal of the proposed research project is to determine the contribution of information technology and legal regulation in the process of democratization, development and efficiency enhancement of governance of public and private legal persons and different forms of industrial democracy. Like in numerous other social subsystems a big issue of modern corporate and public government and industrial relations is democratic deficit, requests for its diminution and simultaneous demands for preservation of efficiency and economic development. It seems that one of the possible mediators between requests and demands – that are sometimes in diametrical opposition – could be adequate and legally regulated use of information technology. Research work will be performed as analysis of the development of governance of public and private legal persons on the one hand and of the democratization processes on the other. The findings of the research work will be presented in the form of suggestions and solutions for further development of legal regulation and information technology support in above-mentioned fields.
Significance for science
Governance of public and private organizations is subject of modern studies in law, economics and sociology. Slovene legal and economic sciences can contribute to better solutions also in international scale: because of their post-transitional and post-privatization experience they have some specific knowledge in solving questions appearing in the wake of financial and economic crisis. In the field of governance of public law entities we try to clarify some ideas and legal concepts. One of the most important aims in ensuring more competitive, transparent and democratic operation of the public and private organisations will be the possibility of fast, simple and equal access to relevant information. In the research area of social dialogue, employee participation and human rights protection the research will enable findings of new elements, important to form the universal principles concerning social dialogue as a legal phenomenon. The existing knowledge in the area of post-industrial relations is being enlarged. The positive effect of the social dialogue is identified taking into consideration its different forms and levels. Ethic and legal basis for introducing the model of profit sharing of the employees was identified. The same is true as regards the influence of high level of human rights and freedoms on successful human resource management, especially in the area of motivation of employees. These results give grounds for further research of the possibilities of informatics development in this area. Research is multidisciplinary and concentrates on search for synergy between legal and technological aspects, and is being conducted as an integral part of other subprojects and research topics. The results are showing how new information/communications channels affect the balance between two opponent principles in modern societies: request for protection of some categories of information and request for transparency and openness of democratic systems.
Significance for the country
Since the transformation of social and economic system, to transitional period in the nineties, post-transion period in the last decade to the global financial and economic crisis Slovene legal regulation of the public and private legal entities governance has been faced with substantially modifications. Concurrently with underdeveloped social dialogue and deficient information on the operation of corporations and poblic entities it hase contributed to sub-optimal results in the governance of public and private sector. These are some of the reasons why the research on democratic governance of the public and private legal entities and mechanisms for its ensurace are of special importance. Slovenia is involved in global social and economic flows, but nevertheless it should´t miss the opportunity of re-defining the system of governance and participation of different social actors in management of the private and public sector and of searching of creative solutions for operation of both systems. Since markets are becoming more and more globalized, models of social government can not be carried out merely in national context. To maintain and to increase present level of social cohesion and balance Slovenia has to engage in development of creative solutions, which on global level balance interests of capital and enable social justice and legal security. The results of the research area on industrial relations enabled profound discussions on future of slovene social and economic model (with special regard to workers´ financial participation), developement of the slovene social dialogue on the nacional and european level and right decision making in legislative processes when regulating some industrial relations issues that are still regulated with old Yugoslav legislation (e.g. regulation of stirke) and enacting the functions and structure of the tripartite bodies.
